1. OBJECT

These terms and conditions of sale set out the rights and obligations of BEAUTY STREET and the buyer in the framework of the goods offered for sale by BEAUTY STREET featuring in its catalogue, available from: 1 rue Catulle Mendes 75017 Paris.

These terms and conditions of sale encompass all the parties’ rights and obligations, no other conditions may be added to these terms and conditions.

BEAUTY STREET may be identified by the buyer by means of its company name, address, telephone number, company registration number and email address.

The buyer states that they have the legal capacity to enter into an agreement governed by these terms and conditions of sale.

2. LEGAL IDENTITY OF THE COMPANY

BEAUTY STREET is an SARL (Limited Liability Company) governed by French law, with a capital of 9,000 €, registered at the Paris RCS (company register) under the Siren number: 447 739 533 and the Siret number: 447 739 533 00068, having its registered head office at: 1 rue Catulle Mendes 75017 PARIS. Telephone: 0033 (0)1 42 27 57 73.

3. QUALITY CHARTER

All our textile-based products are painstakingly designed (cut, materials) in order to adapt to the specific demands with regard to ease-of-movement that will be placed upon it by the buyer’s professional activities. They are also designed to be worn on a daily basis (both domestic and large-scale/industrial laundry-type care). In order to ensure our products are robust, hard-wearing and of the finest quality, all our fabrics undergo testing - wash testing, pilling resistance testing, colour-fastness after repeated washing, colour-fastness to perspiration tests, resistance to general wear and tear, tear strength testing, abrasion resistance testing, fabric shrinkage testing, other physical change testing, dimensional stability testing.

4. PRODUCTS

4.1 Product characteristics and descriptions

In accordance with the provisions of article L. 111-1 de la code de la consommation (article L. 111-1 of the French consumer code), the buyer may, prior to placing their order, visit BEAUTY STREET’s website, www.beautystreet.com or consult their catalogue

5. PRICES

The prices of products featured in our catalogue and internet site are shown in euros exclusive of VAT and exclusive of postage and packaging costs. Prices may be modified over the course of the year, it being understood that the prices applicable to the products ordered will be the prices applicable at the time the order was accepted by BEAUTY STREET.

The creation of new taxes or other levies, especially in the shape of ‘green taxes’, or taxes of any other type, or the raising or lowering of such taxes could result in changes to products’ sales prices. Given the significant increases in energy, transportation and packaging costs, as well as the cost of raw materials, BEAUTY STREET reserves the right to change its prices without prior notice.

The VAT rate indicated on the order form will be the rate that was applicable on the day the order was placed.

If delivery is to a non-EU member state, the payment of all relevant customs charges and the completion of any associated formalities is the buyer’s sole responsibility.

6. ACCEPTANCE OF THESE TERMS AND CONDITIONS OF SALE

When the client comes to place their order, they acknowledge that they have read and understood the terms and conditions of sale laid down by BEAUTY STREET and they accept these conditions unreservedly by ticking the checkbox that is provided for this purpose.

These terms and conditions of sale govern the contractual relations between BEAUTY STREET and its client and the two parties accept them unreservedly. These terms and conditions of sale will take precedence over all other conditions featured in any other document, in the absence of express prior written agreement to the contrary.

7. THE DRAWING UP OF CONTRACTS AND ORDERS

The act of placing an order implies the full and unreserved acceptance of and adherence to these terms and conditions of sale.

8. RIGHT TO CANCEL

In accordance with the loi du 6 janvier 1988 (law of January 6th 1988) and directive n° 97.7 du 20 mai 1997 (directive n° 97.7 of May 20th 1997) codified in articles L. 121-20 and following of the Code de la Consommation (the French consumer code), the client has a 7 day cooling-off period, starting from receipt of their goods, in which to return any product to BEAUTY STREET to the address of the order processing centre for an exchange or a refund.

If the buyer exercises their right to cancel in the aforementioned time period, only the cost of the product or products purchased and the postage and packaging charges applied to the dispatch of the original parcel will be refunded; the client will not be refunded postage and packaging charges associated with their return of the product.

Products must be returned in their original state and packaging, complete with all accessories and care/user instructions, so that they can be put back on sale in mint condition. A copy of the sales invoice should be enclosed to facilitate the returns procedure.

9. PRODUCTS NOT COVERED BY THE RIGHT TO CANCEL CLAUSE

In accordance with current legislation, the right to cancel does not apply to the following products:

- articles manufactured specifically for the client (articles that have been customized with an embroidered detail, articles that have been specfically designed for the customer…),

10. PAYMENT METHODS AND SECURE PAYMENT

The buyer must pay for their order at the time they place their order. Payments made are at no time to be considered to be a deposit or a down-payment.
All orders must be paid for in euros.
To pay for their order, the buyer may use the following methods of payment: debit/credit card, bank transfer or cheque.
If payment is made by bank transfer, BEAUTY STREET will acknowledge payment as soon as its bank account is credited by the amount in question.

In the event that the payment made does not cover the full price of the article(s) ordered, the article or articles will be withheld until they have been paid for in full. If the buyer has supplied an incorrect address or if there are anomalies or other problems with the customer account, BEAUTY STREET reserves the right to withhold the order until the problem has been resolved. If a cheque is rejected because of insufficiency of funds, a 15 euro management fee will be payable to BEAUTY STREET.

If payment is made by cheque, the total payment due for your order will include postage and packaging costs. Your order will only be accepted upon receipt of your cheque. Cheques should be sent to BEAUTY STREET – 1 rue Catulle Mendes 75 017 PARIS.

Payments for online purchases may be made by credit/debit card (Carte Bleue, Visa and MasterCard). Payment should be made at the time of the order being placed and the payment procedure is completely secure.

All details of the transaction are sent in encrypted form via a secure SSL (Secure Socket Layer) connection to a banking server.

Easy terms of payment: BEAUTY STREET offers the chance to pay for any order worth more than 400 euros inclusive of VAT in 3 monthly instalments at no extra charge (applicable to residents of France only, the request to pay by instalments must be made at the time of the order being placed).

The buyer states that they are authorized to use the credit/debit card in question and that there is a sufficiency of funds in the account to which this card is linked to cover all the costs associated with the payment of their order.

BEAUTY STREET reserves the right to suspend or cancel any order and/or delivery, regardless of its content or state of completion/fulfilment in the event of the non-payment of any sum owed by the buyer or in the event of any other payment problem or irregularity.

Penalties equivalent to the legal rate of interest plus 3 percentage points are applicable as of right to any outstanding amounts owed. These penalties may be applied as soon as notification has been received that a client’s payment via a credit/debit card or any other means of payment has been rejected. Delivery of subsequent orders may be suspended in the event of late payment for an earlier order, notwithstanding any provision contained herein.

In order to ensure that payment by credit/debit card is secure, the buyer must communicate the Card Verification Value (CVV) on the back of their credit/debit card to BEAUTY STREE

11. REFUNDS

Refunds for the products concerned by articles 8 and 9 will be offered as quickly as possible, no more than 30 days at the latest after the date the buyer exercised their right to request a refund. BEAUTY STREET will offer a refund to the client in whose name the order was placed, by way of cheque or by crediting their bank account. Refunds will be made to the address featuring on the invoice. The client is at liberty to choose an alternative form of refund. However, it should be noted that if full or part payment was made in gift vouchers, a refund for the amount in question will not be offered, either in cash, by means of a cheque or by a credit/debit card refund. Refunds for purchases made using gift vouchers will only be offered in the form of gift vouchers of the same value as those used in the purchase of the product(s) being refunded.

12. RETENTION OF TITLE

All delivered products remain the property of BEAUTY STREET until they have been paid for in full and until such times as the buyer has fulfilled all their obligations towards BEAUTY STREET.

13. RESERVE DE PROPRIETE

BEAUTY STREET se réserve expressément la propriété des produits livrés jusqu'au paiement intégral du prix de vente et plus généralement jusqu'à ce que l'acheteur ait rempli toutes ses obligations à l'égard de BEAUTY STREET.

In the event of non-performance by the client of all or part of the contract (i.e. payment in full), all monies paid by the client towards the purchase of their goods will be retained by BEAUTY STREET by way of penalty.

13. DELIVERY

The buyer is required to supply BEAUTY STREET with all the information that is necessary for the delivery to be successfully made. In the event that the wrong address or an incomplete address has been supplied, the recipient’s name is not clearly marked outside their property or on their letter box or if BEAUTY STREET has not been given the necessary information in relation to closing days, or if the property to which the delivery is to be made is not open, the cost of redelivery will be met in full by the buyer. If the buyer requests a refund, BEAUTY STREET cannot refund the postage and packaging costs levied on the first delivery.

Invoices are automatically sent to the main address supplied by the Client when they opened their customer account.

Failure to comply with the aforementioned procedures will render inadmissible any claim or complaint by the buyer.

13.1 Dispatch of orders and delivery times

Orders placed and paid for by credit/debit card, cheque or bank transfer will be processed by 11am (once payment has been received).

When the order is ready, it is given to the courier.

After this, delivery takes between 48 and 72 hours (during the business week). If no-one is in to receive the courier, they will leave a ‘redelivery’ or ‘something for you’ card in the letter box. The buyer will have about 10 days in which to collect their delivery from the local post office or depot (in France, for other countries, consult the postal services in question), starting from the day that the ‘redelivery’ or ‘something for you’ card was left in the letter box at the address supplied by the client. If the Buyer does not have the ‘redelivery’ or ‘something for you’ card with them, they may still be able to collect their parcel by bringing identification and the tracking Number of their parcel to their local post office branch. If the parcel has not been collected by the end of the relevant time period, it will be sent back to the BEAUTY STREET warehouse. The customer department will then contact the client to arrange for the redelivery of the item, if so desired. The postage and packaging costs for this redelivery are payable in full by the client.

For orders to addresses outside mainland France and Corsica, in other words, DOM TOM, Europe and all other overseas destinations, an international postage and packaging rate will be applied. Deliveries will take between 8 and 15 days.

Deliveries sent via a ‘Courier’ will take between 24 and 48 hours. If the client is not at home, the courier will leave a redelivery card with a telephone number to phone in order to arrange a redelivery time that suits the client.

These delivery times do not take into account the impact that any stock shortage could have. The delivery times for orders of customized clothing or clothing specifically tailored to individual clients will vary depending on the items of clothing in question (approximate delivery times: 3 to 10 weeks).

If the buyer has any worries whatsoever about the condition or contents of their parcel, they must inform BEAUTY STREET of their concerns via the internet site’s contact section or by telephone, on the same day that they received the parcel.

Delivery times are to be understood as estimates only and are subject to the availability of the product(s) ordered.

The client will be informed by telephone or email of any delay to their delivery. The client will then be offered a new delivery date. In any case, in the event of a delay of more than seven (7) days, the client will have the right to cancel their order within sixty (60) business days, in accordance with the relevant legislation. If, under these circumstances, the client receives their parcel after having cancelled their order, BEAUTY STREET will refund the cost of the product and the postage and packaging costs incurred in returning the item to BEAUTY STREET. These costs will be refunded as soon as BEAUTY STREET receives the parcel in its original state and packaging and with no items missing.

13.2 Postage and packaging costs

You will be informed of the cost of your order’s postage and packaging when you confirm your order and before payment is made.

13.3 Disputed delivery / parcel lost by THE POSTAL SERVICE PERFORMING THE DELIVERY

If the postal service’s tracking service indicates that the parcel has been delivered but the client has not received it, the client must contact the BEAUTY STREET customer service department (contact@beautystreet.fr). BEAUTY STREET will investigate the matter, contacting the postal service in question in order to request proof of delivery. The French postal service has a maximum of 3 weeks in which to send us proof of delivery.

If the postal service in question is not able to send us documentary proof of delivery, the parcel will be classified as lost and we will refund your order. BEAUTY STREET will inform the client of this step and will immediately begin the process of refunding the order in question (cost of articles contained in parcel and postage and packaging costs).

However, if the postal service in question sends us documentary proof of delivery, we will not be able to file a claim against them and we will therefore not be able to offer a refund for your order.

As the articles will have been delivered by the French postal service’s Colissimo Access service, the buyer must adhere to the relevant Colissimo procedure (i.e. report any damage and put any claims or complaints into writing) and, if necessary, obtain a copy of the form designed for this purpose, available from any French post office.

13.4 Disputed delivery / parcel lost by COURIER

Any irregularity occurring during transportation, or at least, which is detected upon delivery (damage to articles, incomplete order – product missing that was featured on the delivery note, damage to parcel, broken articles…) must be noted in writing on the shipping invoice and signed by the client.

For the purposes of filing a claim in relation to a lost parcel, we need a photocopy of the client’s identity card/passport, together with a signed declaration of non-delivery. If this procedure is not adhered to no refunds will be offered.

 

14. STATUTORY RIGHTS

The client’s statutory rights are not affected by the guarantee applying to any latent defects found in the products sold.

Provided that the buyer can provide evidence of the latent defect, the seller must remedy all resultant consequences (Art 1641 and following of the French Civil Code); if the buyer decides to take their claim to court, they must do it within a "short period of time" after the discovery of the latent defect (art 1648 of the French Civil Code).

15. PRODUCT RETURNS – DELIVERY MISTAKES – NON-CONFORMITIES

All returns must be sent back by post to the BEAUTY STREET Customer Service department, 1 rue Catulle Mendes 75017 PARIS, together with the relevant completed Returns Form, stating whether you would like to exchange the item returned, receive store credit for it or a refund.

If you had to return the article(s) because of negligence on the part of BEAUTY STREET (damaged article, wrong article dispatched), we will refund your postage and packaging costs (on receipt of a request for a refund in writing). You must enclose a receipt from the Post Office as proof of the postage and packaging costs you have had to pay (parcels sent by track and trace-style services only).

When returning an article, the following instructions must be followed:

The article(s) in question must not have been worn or washed. It/they should be folded carefully and put back into its/their original packaging. The article(s) to be exchanged must be returned with the Returns Form to BEAUTY STREET and the reason for their being returned should be stated.

Articles that have been customized by means of embroidery and articles specifically tailored to you may not be exchanged or returned. Our exchange and refunds policy does not apply to articles exhibiting normal wear and tear or articles that have been damaged following dispatch (tears, burn marks, mould, use of chemical products etc), or to articles that have been damaged due to non-compliance with the use and care guidelines.

Failure to comply with the above guidelines within the relevant time limits will debar the buyer from making any complaint or claim in relation to non-conformity of delivered products or conspicuous defects relating to the said products. The products will therefore be deemed to be compliant with the order and free from any conspicuous defects.

The return of the product is at the buyer’s own risk and expense.

If the product is lost by the courier during the course of this delivery, the buyer will be held liable and will not receive any refund from BEAUTY STREET.

BEAUTY STREET does not accept ‘postage due’ parcels.

The initial delivery costs for returns will not be refunded.

If the parcel is returned directly to our delivery hub rather than to the return address indicated on the lower portion of the Returns Form, the client will be charged an additional management fee of 15€.

If the client wants to exchange their article, they will receive the exchanged article at no additional cost. If the article(s) is/are exchanged for a more expensive article or articles, the difference in price must be paid before the exchanged article(s) can be dispatched. The client can exchange articles from 2 orders. Beyond this limit, they will automatically receive store credit.

If the return is not accepted by our Customer Service department, the buyer cannot exercise their right to return the article and they must keep their purchase. They will not receive any refund or store credit. If the return is not accepted by the Customer Service department, but the buyer nonetheless sends the product back, the buyer will not receive any refund. If the buyer changes their mind and wishes to have their article returned to them once again, they must formulate a request by email or in writing by post to BEAUTY STREET. BEAUTY STREET will return their article to them as quickly as possible. The cost of returning the article will be met by the buyer and must be paid in advance by credit/debit card.

16. LIABILITY

BEAUTY STREET may not be held liable for non-performance of contract in the event of a stock shortage or the unavailability of a product due to a force majeure event, disruption or general or partial strike action/partial performance, especially that affecting the postal services, the transportation system, communications and/or our suppliers.

BEAUTY STREET may not be held liable for any indirect damage or injury resulting from the purchase of our products.

Moreover, BEAUTY STREET will not be held liable for non-compliance with regard to legislation in force in states to which the product may be delivered (for example, in the event that a product is banned in the state in question). It is the client’s responsibility to check with the relevant local authorities whether they are authorized to import or use the products or services that they intend to order.

The actual products may differ from the photographs supplied.

BEAUTY STREET may not be held liable for any kind of material damage, consequential loss or bodily injury that could result from a malfunction in the operation of or the improper use of products sold.

There are inherent risks in using the internet such as temporary suspension of access, network intrusion, computer viruses and loss of data or files. BEAUTY STREET assumes no liability or responsibility for any of these risks. It is the buyer’s responsibility to take all necessary security measures and perform all necessary backups.

The same provisions apply to any modifications to products that are effected by the product manufacturers.

Regardless of whether the products purchased are to be used in a working or non-working environment, BEAUTY STREET may not be held liable for any consequential loss arising from the following, business interruption, loss of profits, loss of opportunity, damages or expenses that could result from the purchase of these products.

BEAUTY STREET’s liability will be limited to the value of the order. This clause does not constitute an admission of liability. This liability will not be invoked as a result of simple errors or omissions that may have remained undetected despite the precautions taken in the presentation of the products. In the event of disagreements over the application of this contract, the buyer has the option of seeking an amicable agreement before taking the matter to court. In this they may look for assistance from an industry body, a consumer organization or any other body that can offer them relevant advice.

It should be noted that the search for an amicable agreement must be conducted within the time-frame provided for in the legislation relating to the client’s statutory rights, i.e. within a "short period of time".

It should be remembered that as a general rule, subject to the discretion of the Courts, the observance of the provisions of this contract relating to the contractual guarantee is predicated on the assumption that the buyer honours their financial commitments towards the seller.

In the event of a dispute, the client should first contact the company in order to try to reach an amicable agreement.

If this does not succeed, the matter will be brought before a competent court.

17. FORCE MAJEURE

Proceedings may not be instituted against either of the two parties for the non-performance of their contractual obligations if performance of the said obligations was delayed, hindered or prevented by a fortuitous event or force majeure. Fortuitous events or force majeure events are defined as any occurrence or set of circumstances that are irresistible, unforeseeable, external to the parties, which take place independently of the will of the parties and which cannot be prevented by the parties, despite the latter doing all that could be reasonably expected of them.

The party affected by these circumstances will inform the other Party within ten business days of the date on which it became aware of the fortuitous or force majeure event. The two parties will meet within one month, unless this meeting is rendered impossible by the force majeure event, in order to examine the impact of the event and to come to an agreement on how the obligations under the contract might still be performed. If the force majeure event lasts for more than three months, these terms and conditions of sale may be terminated by the aggrieved party.

Specifically, fortuitous events or force majeure events, besides those usually considered as such by case law of French law courts and tribunals, are defined as the blockage of the transportation or supply systems, earthquakes, fire, storms, floods, lightning; the breakdown of the telecommunications network or problems with the telecommunications network caused by external factors not connected with the client.

18. INTELLECTUAL PROPERTY RIGHTS

All our products are protected under intellectual property law, having been registered with the INPI (the French patent office) and similar international bodies. It is a violation of current intellectual property legislation to attempt to copy or to copy these products, designs or elements thereof, either in France or abroad.

BEAUTY STREET, Beautystreet.fr and the BEAUTY STREET logo are registered trademarks belonging to BEAUTY STREET, 1 rue Catulle Mendes 75017 PARIS.

The reproduction and representation of these trademarks is prohibited by intellectual property legislation. Beauty Street reserves all its rights in relation to these trademarks.

All of the elements, brands, drawings, product designs, logos, music, graphic design elements, data etc contained in the internet site and the catalogue are the property of BEAUTY STREET. It is strictly forbidden to copy, modify, retrieve or distribute these elements, whether in their entirety, or a part thereof, regardless of the procedure or method employed, for any purposes other than strictly personal use.

Texts, page lay-out and photographs are the property of BEAUTY STREET. They are protected by copyright law. In the absence of written permission from the interested party, all unauthorized reproduction, reissue or distribution, regardless of the method used, is prohibited by law.

Unless stated otherwise, the Contents of the internet site and the catalogue is protected by copyright.

Any reproduction, representation, distribution or use of the contents of the internet site or the catalogue, regardless of the procedures or methods employed, in defiance of the legislation and regulations relating to copyright, constitutes infringement of copyright, which is a criminal offence.

19. PERSONAL DATA IDENTIFIERS

The Client expressly gives BEAUTY STREET permission to process their personal data in the conditions set down below. The data thereby collected is necessary for order processing and fulfilment purposes and to meet BEAUTY STREET’s statutory and regulatory obligations.

This data is for the use of BEAUTY STREET and its business partners (service providers providing the services ordered and suppliers).

19.1 – Collection and use of personal data:

BEAUTY STREET collects and sorts the Client’s personal data via its IT systems. This is used to strengthen the relationship between BEAUTY STREET and the Client using market research findings, and to inform the Client of BEAUTY STREET’s special offers.

19.2 – Security and access to data stored on computer systems:

Access to the Client’s personal data is restricted to individuals who are authorized to carry out data processing work and tasks relating to IT security and maintenance.

19.3 – Updating and correction of personal data:

In accordance with the law of 6th January 1978 (la loi informatique et libertés du 6 janvier 1978), relating to data storage on computer and data protection, the Client has the right to access, modify, correct and demand the removal of any of their personal data stored on computer

19.4 – Withdrawal of consent:

The Client may withdraw their permission with regard to the use of their personal data as described above at any time.

19.5 - Contact

In accordance with the law of 6th January 1978 (Loi « Informatique et Libertés du 6/01/1978 »), the Client must contact the BEAUTY STREET customer service department in writing if they wish to make corrections to their personal data or withdraw their permission with regard to the use of their personal data.

BEAUTY STREET may send details of its sales offers, promotions, products and services via email.

However, the Client may ask to be removed from this emailing list at any time, either via email by clicking the link designed for this purpose and generally located at the end of the email message, or by post to the BEAUTY STREET customer service department at the address stated above.

20. PARTIAL INVALIDITY

The cancellation of one of the provisions of these terms and conditions of sale will not result in the cancellation of these terms and conditions of sale as a whole. The other provisions will retain all their legal force and scope.

21. NON WAIVER CLAUSEE

If one of the parties does not take action regarding a breach by the other party with regard to any of the obligations contained herein, this should not be understood as constituting a waiver.

22. MODIFICATIONS TO THESE TERMS AND CONDITIONS OF SALE AND USE

BEAUTY STREET reserves the right to change these terms and conditions of sale. In this event, the Client will be given prior notice in writing.

23. APPLICABLE LAW AND COMPETENT COURTS

Contracts governing the sale of products by BEAUTY STREET are subject to French law.

Any disputes arising, whether with industry professionals and/or retailers, will come under the jurisdiction of the Paris law courts (FRANCE).

Any disputes relating to the interpretation, performance or the breach of the contract entered into between BEAUTY STREET and the buyer that cannot be amicably resolved shall, notwithstanding a plurality of respondents, fall under the exclusive jurisdiction of the competent courts of law of the locality where the Company’s registered head office is sited or the locality of the registered head office of the company to which the goods in question were delivered or where the service in question was performed.

24. LEGAL INFORMATION

Article L 211-4 du Code de la consommation (Article L 211-4 of the French consumer code):

The seller must deliver goods in compliance with the contract and is liable for any non-comformities existing on delivery. They will also be held liable for non-conformities arising from the product packaging, assembly instructions or product installation, in the event that installation is included in the provisions of the contract or if the seller is legally responsible for the performance of this installation.

Article L 211-5 du Code de la consommation (Article L 211-5 of the French consumer code):

In order to be in conformity with the contract of sale, the consumer goods must be:

1° Fit for the purposes for which goods of the same or a similar type are normally used, and, where relevant:

- comply with the description given by the seller and possess the qualities of the goods which the seller has presented to the buyer in the shape of a sample or model;

- possess the qualities that a buyer might reasonably expect of them in the light of public statements made by the seller, the producer or their representative, particularly expressed via advertising or labelling;

2° Or possess characteristics and qualities jointly defined by the parties, or be fit for any specific purpose required by the buyer, this purpose having already been made known to the seller and having been accepted by the latter.

NB: Ruling 2005-136 2005-02-17 art. 5: The provisions of this ruling apply only to contracts concluded after its coming into force.

Article L 211-12 du Code de la consommation (Article L 211-12 of the French consumer code):

Any claim arising out of a non-conformity must be lodged within two years from the time of delivery of the goods.

Article 1641 du Code civil (Article 1641 of the French civil code):

The seller is bound to honour their warranty on the basis of latent defects in the item that was sold if these defects render it unfit for the purpose for which it was designed, or reduce its effectiveness in fulfilling this purpose to such an extent that the buyer would not have purchased it, or would have only purchased it at a reduced price, if they had been aware of them at the time.

Article 1648 alinéa 1er du Code civil (first paragraph of Article 1648 of the French civil code):

Any claim arising out of the discovery of latent defects must be lodged by the buyer within two years of the discovery of these defects.

25. CLIENT REFERENCE AGREEMENT CLAUSE

The Client gives explicit permission to BEAUTY STREET to use its brands, logos and trade names by way of a customer reference on BEAUTY STREET’s marketing material and on all written collateral and online platforms. This agreement clause may not be interpreted as a licence to generate revenue through the use of the Client’s brands, logos and trade names, the Client’s permission to use its brands, logos and trade names being exclusively designed to signal its status as a satisfied client or sales partner.

Pursuant to this clause, BEAUTY STREET has the Client’s permission to reproduce (by means of photographs or drawings) items sold to the Client (including custom-embroidered items or items custom-made for the Client). The Client also gives BEAUTY STREET permission to publish any content featuring the items sold by BEAUTY STREET to the Client on BEAUTY STREET’s social media platforms and marketing communications for promotional and informational purposes.
